1. Acceptance of These Terms
These Terms of Use ("Terms") form a legally binding agreement between you ("you" or "User") and ("we", "us" or "our"), the entity that owns and operates the Merovian Stay hotel-casino located in Alkimos, Western Australia, and the website available at merovianstay.com (the "Site").
By accessing, browsing or otherwise using the Site in any way, you confirm that:
- you have read, understood and agree to be bound by these Terms in their entirety;
- you have the legal capacity to enter into a binding agreement under the laws of Western Australia and the Commonwealth of Australia; and
- where you access the Site on behalf of an organisation, you have authority to bind that organisation to these Terms.
If you do not agree to these Terms, you must immediately cease using the Site. We reserve the right to amend these Terms at any time. Amendments take effect from the date they are published on this page. Your continued use of the Site after any amendment constitutes your acceptance of the revised Terms. 2. Purpose of the Site
The Site is operated as a commercial and informational platform for the Merovian Stay hotel-casino. Its purposes include:
- presenting information about accommodation, gaming facilities, dining, event spaces and ancillary services offered at the property;
- enabling visitors to make or submit accommodation reservation requests;
- providing details of rates, packages, promotions and property policies; and
- facilitating communication between prospective and existing guests and the property.
The Site is not a gaming platform. No real-money wagering, gaming, or gambling activity is conducted through the Site. Gaming facilities are available exclusively on the physical premises of Merovian Stay in Alkimos, Western Australia, subject to all applicable entry requirements and conditions set out in these Terms and communicated on-property.
3. Permitted Use of the Site
3.1 Authorised Use
You may access and use the Site solely for lawful, personal, non-commercial purposes connected with the services offered by Merovian Stay. Specifically, you are permitted to:
- browse information about the property and its facilities;
- submit reservation requests for accommodation;
- contact the property through provided communication channels; and
- download or print pages for your own private, non-commercial reference.
3.2 Prohibited Conduct
You must not use the Site to:
- engage in any activity that is unlawful, fraudulent or deceptive;
- transmit unsolicited commercial communications or spam;
- collect, scrape or harvest personal data of other users or information from the Site by automated means;
- introduce viruses, trojans, worms, logic bombs or other malicious or harmful code;
- attempt to gain unauthorised access to any part of the Site, the server on which the Site is hosted, or any server, computer or database connected to the Site;
- launch denial-of-service or distributed denial-of-service attacks;
- copy, reproduce, distribute, modify or create derivative works from any content on the Site without our prior written consent;
- frame or deep-link to any page of the Site without our prior written consent; or
- use the Site in any manner that could damage, disable, overburden or impair it or interfere with any other party's use.
We reserve the right to restrict, suspend or terminate your access to the Site immediately and without notice if we reasonably believe you have breached any provision of these Terms or any applicable law.
4. Intellectual Property
4.1 Ownership
All content on the Site — including but not limited to text, graphics, photographs, illustrations, video, audio, logos, icons, data compilations, software and the overall look and feel of the Site — is either owned by or is used under licence from third-party rights holders. All such content is protected by Australian and international copyright, trade mark and other intellectual property laws.
4.2 Trade Marks
The name "Merovian Stay", the associated logo and any other marks displayed on the Site are trade marks of . Nothing in these Terms grants you any right, title or interest in those marks. You must not use them in any way without our prior written authorisation.
4.3 Limited Licence to Users
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site and its content strictly in accordance with these Terms. This licence does not include:
- any right to reproduce, publicly display or perform, distribute, modify or create derivative works from Site content;
- any right to use data mining, robots or similar data-gathering tools; or
- any right to use the Site or its content for any commercial purpose not expressly authorised by us in writing.
4.4 User-Submitted Content
If you submit any content to us through the Site (such as enquiry messages or review responses), you grant us a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, adapt and publish that content in connection with the operation and promotion of the property. You warrant that any such content does not infringe third-party rights and complies with applicable law.
5. Reservation Requests and Booking Terms
5.1 Nature of Reservation Requests
Submitting a reservation request through the Site constitutes an offer by you to book accommodation on the terms stated. A binding reservation is formed only when we issue a written confirmation to the email address you provide. We reserve the right to decline any reservation request at our discretion.
5.2 Accuracy of Information
You must provide complete and accurate information when making a reservation request, including your full name, valid contact email address, intended arrival and departure dates and the names of all guests. We are not liable for booking failures or errors arising from information you have provided incorrectly.

5.5 Cancellation and Modification
Cancellation and modification conditions vary by rate type and are set out in your booking confirmation. You should review these conditions carefully before confirming your reservation. General conditions are as follows:
- Flexible rates: Cancellation without charge is permitted up to the time specified in your confirmation. Cancellations received after that time may incur a fee equivalent to one or more nights' accommodation.
- Non-refundable rates: No refund is available in the event of cancellation or no-show. The full booking amount is charged at the time of confirmation.
- Group bookings: Separate terms apply and will be communicated in a group booking agreement.
5.6 No-Show Policy
If you fail to arrive on your confirmed arrival date without prior notification, we reserve the right to treat the booking as cancelled and release the reserved accommodation. Charges applicable to no-shows are set out in your booking confirmation.
5.7 Property Policies
All guests are required to comply with the property's house rules, which are communicated at check-in and available from our front desk team. We reserve the right to ask any guest to leave the property if they breach those rules or behave in a manner that is disruptive, unlawful or contrary to the welfare of other guests or staff.
6. Age Requirements
6.1 Accommodation
Guests must be at least 18 years of age to make a reservation and check in as the lead guest. Guests under 18 years of age may stay at the property only when accompanied by a parent or legal guardian throughout their stay and subject to applicable property policies.
6.2 Casino Facilities
Access to the gaming floor and all casino facilities at Merovian Stay is strictly limited to persons who are 18 years of age or older. This requirement is enforced in accordance with applicable Western Australian legislation governing gaming venues. Valid photographic identification establishing age may be required at any time as a condition of entry to gaming areas. Any person who is unable to provide satisfactory proof of age will be refused entry.
It is the responsibility of all guests and accompanying parties to ensure that minors do not access gaming areas. We reserve the right to remove any person from the gaming floor if there is reasonable cause to believe that person is under the minimum age or has provided false identification.
7. Responsible Gaming

10.2 Exclusion of Consequential Loss

Where such statutory rights apply, our liability is limited, to the extent permitted by law, to re-supplying the relevant service or paying the cost of having the service re-supplied.
10.4 Cap on Liability
Subject to clause 10.3, our aggregate liability to you arising out of or in connection with these Terms or your use of the Site shall not exceed AUD $500 or the amount you have actually paid to us in the three months immediately preceding the event giving rise to the claim, whichever is greater.
10.5 Indemnity
You agree to indemnify, defend and hold harmless and its directors, officers, employees and agents from and against any claims, liabilities, damages, penalties, fines, costs and expenses (including reasonable legal fees) arising from:
- your breach of these Terms;
- your violation of any applicable law or regulation; or
- your infringement of the rights of any third party.

12. Governing Law
These Terms are governed by and construed in accordance with the laws of Western Australia and the applicable laws of the Commonwealth of Australia, without regard to conflict-of-law principles.
You and we each irrevocably submit to the non-exclusive jurisdiction of the courts of Western Australia and any courts competent to hear appeals from those courts in respect of any dispute, claim or proceeding arising out of or in connection with these Terms or the Site.

13.2 Escalation
If a dispute is not resolved within 30 days of your initial written complaint, either party may refer the matter to mediation conducted by a mutually agreed mediator. The costs of any such mediation shall be shared equally unless otherwise agreed in writing.

If your complaint relates to gaming activities at the property, you may also have the right to raise concerns with the relevant Western Australian gaming regulatory authority. 13.4 Consumer Complaints
You may also have the right to seek assistance from the Australian Competition and Consumer Commission (ACCC) at accc.gov.au or from Consumer Protection WA at commerce.wa.gov.au in respect of consumer rights matters.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy and any booking confirmation or separate written agreement entered into with you, constitute the entire agreement between you and us in respect of your use of the Site and supersede all prior representations, understandings and agreements relating to that subject matter.
14.2 Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful or unenforceable, that provision shall be severed from the remainder of these Terms, which shall continue in full force and effect.
14.3 Waiver
Our failure to enforce any right or provision of these Terms on any occasion does not constitute a waiver of that right or provision. Any waiver must be expressly made in writing and signed by an authorised representative of .

You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign these Terms or any rights arising under them to any successor entity or in connection with a restructure, merger or sale of the business, without your consent.

These Terms are written in the English language. In the event of any conflict between an English version and any translated version, the English version shall prevail.
